Article 1. Object

The general terms and conditions of sale described below detail the rights and obligations of the Easyboost company and its customers in connection with the sale of parts available on the easyboost.fr sales site.

Any service provided by Easyboost implies the buyer's unreserved acceptance of these general terms and conditions of sale.

Article 2. Prices

The prices of the goods sold are those in force on the day the order is placed. They are denominated in euros.

Additional and variable shipping costs are applied to each order placed.

Easyboost grants itself the right to change its rates at any time.

However, it undertakes to invoice the goods ordered at the prices indicated when the order is placed.

Article 3. Discounts and rebates

The proposed rates include the discounts and rebates that easyboost would have to grant in view of its results or the buyer's assumption of certain services.

Article 4. Discounting

No discount will be granted in the event of early payment.

Article 5. Methods of payment

Payment of orders is made by cheque, credit card, bank transfer, via the Paypal© online payment platform, by cash order, or by cash on delivery.

When the order is placed, the buyer must pay the full amount of the invoice.

During a purchase in cash on delivery, if the buyer is absent at the time of delivery, if he does not appear at the point indicated on the delivery notice to collect the package, and if the package is returned to the sender, the customer who placed the order undertakes to refund in full the shipping costs incurred by the sender within 15 days.

Article 6. Default of payment and retention of title clause

In the event of total or partial non-payment, the order cannot be shipped.

The Easyboost company retains ownership of the goods sold until full payment of the order price has been received.

Article 7. Shipping & Returns

Delivery is made by shipment from our warehouses located in France and Germany to the address provided by the buyer or as a relay point, for the attention of the buyer.

The delivery time indicated when the order is registered is given for information only and is in no way guaranteed. However, Easyboost undertakes, pursuant to Article L. 121-20-3 of the Consumer Code, to deliver the order within 5 working days for metropolitan France from the date of receipt of payment.

Consequently, any reasonable delay in the delivery of the products may not result in the buyer benefiting from:

- the award of damages;

- the cancellation of the order

The transport risk is borne entirely by the buyer.

Article 8. Condition of the goods

In the event of missing or damaged goods during transport, the buyer must make all necessary reservations on the purchase order upon receipt of said goods. These reservations must also be confirmed in writing within 5 days of delivery by registered letter AR.

Article 9. The withdrawal period

According to article L.121-20 of the Consumer Code, any consumer has a period of 14 days to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs. 

Article 10. Validity of electronic exchanges

The Client acknowledges the validity and probative value of the electronic exchanges and records made by easyboost.fr and accepts that said records receive the same probative value as a handwritten written document.

Article 11. Limitation of use

The articles offered on the easyboost.fr website, when installed on motorcycle, make them unapproved for use on the road. By placing an order on the easyboost.fr website, the buyer therefore undertakes not to violate the legislation on the modification of motorized equipment by misusing the ordered parts. Although designed with a constant concern for reliability, easyboost cannot guarantee the perfect resistance of its products when they are subjected to situations diverted from those for which they were designed, namely: adding an aesthetic dimension to reserved vehicles.

Article 12. Force majeure

The responsibility of Easyboost cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in the present general terms of sale results from a case of force majeure. In this respect, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code.

Article 13. Jurisdiction

Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law. In the absence of an amicable settlement, the dispute shall be brought before the Strasbourg Commercial Court.
